In what circumstances is cover required?
Where an individual or a company is bringing a civil action against a third party for damages and wishes to protect themselves against costs awarded against them in the event that the action is unsuccessful.
In some cases it is possible to arrange cover where the proposer is the defendant in the legal action.
Risks covered: the payment of costs awarded against the insured together with certain elements of their own costs and disbursements.
These covers are suitable for cases where no annual insurance is in force.
Cover can usually be arranged on a basis where payment of all (or a large proportion) of the premium is deferred until the outcome of the case is known and is then only payable where the client is successful.
