There is regular discussion in the press about insurance against, for example, breach of Restrictive Covenants given that many are likely to be proved unenforceable.

In this article Paul Butt argues eloquently for the fact that Title insurances provide huge benefit as legal expenses covers as well as covering the ultimate risk. As he says:

“A key advantage of title insurance – which is not always emphasised to clients – is that many policies will also provide a form of legal expenses insurance to enable the client (via the insurers) to contest any claim brought against them in respect of the risk covered by the policy. Particularly significant when you consider the high cost of bringing or defending litigation these days and the enormous reduction in the availability of legal aid…”
